LaiPower General Terms and Conditions

1.1 User as Primary User

LaiPower and the user are the primary parties to this agreement. Users are responsible for complying with all provisions in these Terms.

When you rent a shared power bank through the LaiPower App, web application, or another designated method, you are responsible for using, keeping, and returning that device.

If you allow another person to use the shared power bank rented under your account, you remain fully responsible for its use, safekeeping, damage, loss, non-return, and any resulting fees or liabilities.

1.2 Devices Remain LaiPower Property

All LaiPower shared power banks, rental stations, charging cables, devices, parts, and related hardware remain the property of LaiPower or its authorized parties. Users receive only a limited right to use the device during the rental period and do not acquire ownership.

Without prior written consent from LaiPower, users must not:

1. Disassemble, open, repair, modify, or damage any device;
2. Scratch, puncture, hit, bend, write on, remove labels from, or otherwise damage any device;
3. Use any device for illegal purposes, resale, advertising, or abnormal use;
4. Attempt to hack, bypass, interfere with, or access LaiPower devices, systems, App, website, or backend services without authorization;
5. Charge, modify, or connect devices using methods not approved by LaiPower.

If a user breaches these Terms and causes damage, loss, malfunction, safety incidents, or third-party loss, the user is responsible for the relevant liabilities and costs.

1.3 Device Operating Time and Availability

Shared power banks are electronic devices that require regular charging. Their usable time, remaining battery, and charging performance may be affected by device condition, usage, phone model, cable, temperature, device aging, network status, and other factors.

Users understand and agree that:

1. Device battery will decrease during use;
2. Battery level may differ at the time of rental, and LaiPower does not guarantee every rented device is fully charged;
3. Discharge speed and usable time are not guaranteed absolutely;
4. Users should check whether the device works normally after rental;
5. If a device is visibly damaged, overheats, cannot charge, cannot connect, or presents any safety concern, the user must stop using it and contact LaiPower immediately;
6. If the device runs out of battery during rental, the user must still return it in accordance with these Terms.

LaiPower will use reasonable efforts to maintain devices and services, but does not guarantee that all devices will be available at every time or location.

1.4 Reporting Damage, Abnormality, Accident, Loss, or Theft

If a user discovers device damage, abnormality, malfunction, loss, theft, accident, property loss, personal injury, or safety issue during use, the user should notify LaiPower as soon as possible through the App, website, or customer support channel.

If personal injury, property loss, device loss, or theft is involved, the user should notify LaiPower as soon as reasonably practicable and, where necessary, report the matter to the relevant enforcement authority or venue management.

1.5 User Responsibility

During the rental period, the user must properly keep the rented shared power bank and use it in a normal, safe, and lawful manner.

The user agrees to be responsible for:

1. Loss caused by improper use, intentional damage, negligence, loss, non-return, or breach of these Terms;
2. Damage, loss, fees, or liability arising from allowing another person to use the device;
3. Claims, fines, fees, or losses resulting from breach of applicable laws, venue rules, or third-party rights;
4. Consequences arising from unauthorized disassembly, modification, repair, charging, or connection of the device.

The user should return the device in the same condition as rented or in a condition consistent with reasonable normal use. Ordinary wear and tear from normal use is not treated as user liability.

2.1 Rental Fees

Users must pay the relevant fees shown in the App, web application, payment page, or rental page when using LaiPower services.

Fees may include rental fees, deposits, overtime fees, non-return fees, device loss fees, device damage fees, device purchase fees, applicable taxes, processing fees, or third-party payment service fees.

Actual charges are based on the prices displayed in the App, web application, or payment page at the time of rental.

2.2 Deposit

Before renting a shared power bank, users may be required to pay a deposit. The deposit amount will be as displayed in the App, web application, or payment page.

After the rental ends, LaiPower may deduct applicable rental duration fees, device condition charges, and other payable amounts from the deposit.

If any balance remains after deduction, it will be refunded according to LaiPower refund rules to the original payment method, account balance, or another refund method supported by LaiPower.

2.3 Insufficient Deposit

If the deposit is insufficient to cover actual rental fees, overtime fees, device damage fees, loss fees, non-return fees, or other payable amounts, LaiPower may collect the shortfall through the user's bound or used payment method.

2.4 Maximum Rental Period, Non-Return, and Purchase Treatment

Users must return shared power banks to supported LaiPower return stations within the maximum rental period designated by LaiPower.

If the user does not return the device within the maximum rental period, LaiPower may treat the device as not returned, lost, or purchased by the user and charge the applicable fees.

If the user later returns a device after it has been treated as purchased, lost, or not returned, LaiPower may decide whether to cancel or adjust the relevant fees based on the actual circumstances, device condition, system records, and internal policy.

2.5 Valid Payment Method

Users must provide a valid payment method supported and accepted by LaiPower. Users confirm that they are authorized to use the payment method and authorize LaiPower to charge fees related to service use.

2.6 Payment Disputes

If a user believes a fee is incorrect, the user should contact LaiPower within ten (10) business days after the relevant transaction and provide sufficient information for review.

LaiPower system-generated rental, return, payment, device status, and time records may be used as important evidence in resolving disputes.

2.7 Refunds

If the user meets refund conditions, LaiPower will process refunds according to the actual payment method, payment gateway rules, bank processing time, and internal review.

Refunds may be unavailable, partial, or delayed if the device is not returned, damaged, lost, cannot be identified, payment information is invalid, payment processing fails, a transaction is abnormal, or the user breaches these Terms.

2.8 Promo Codes, Discounts, and Campaigns

LaiPower may provide promo codes, discounts, rewards, free rental time, or other promotional campaigns from time to time. LaiPower may modify, suspend, or cancel any promotion at any time.

3.1 Safety Check

Users should reasonably check whether a device has visible damage or abnormality before and after renting, using, or returning it. Users must stop using the device and contact LaiPower immediately if they notice damage, abnormal heat, smoke, odor, leakage, connection failure, cable damage, or any safety concern.

3.2 Lost or Stolen Devices

If a device is not returned within a reasonable time, or records suggest the device may be lost, stolen, or unrecoverable, LaiPower may reasonably treat the device as lost or stolen.

The last renting user will usually be responsible unless LaiPower reasonably determines that the loss or theft was not caused by that user.

3.3 Service Availability Limits

LaiPower will use reasonable efforts to provide stable services, but does not guarantee uninterrupted service availability. Service may be affected by device quantity, battery level, maintenance, station malfunction, network, electricity, payment services, venue limits, force majeure, or other events outside LaiPower's reasonable control.

3.4 Access License

Subject to compliance with these Terms, LaiPower grants users a limited, revocable, non-exclusive, non-transferable license to access and use LaiPower services for normal personal use only.

Users must not resell services, scrape data, use bots, access systems without authorization, or use the services for illegal, fraudulent, abusive, or harmful purposes.

3.5 Copyright and Ownership

All content in LaiPower services, including text, images, designs, software, code, databases, trademarks, and service names, belongs to LaiPower, its affiliates, licensors, or content providers.

3.6 Trademarks and No Endorsement

LaiPower names, logos, service names, icons, designs, and brand elements are trademarks or business identifiers of LaiPower or its authorized parties. Users must not use them without prior written consent.

3.7 Account Registration and Security

Users may need to create an account. Users must provide accurate information, keep login details secure, not transfer accounts, and notify LaiPower immediately if account security is compromised.

3.8 Content Removal Right

If LaiPower services allow user content, users must ensure that content is lawful, truthful, non-infringing, and appropriate. LaiPower may remove, edit, reject, or restrict content that violates these Terms or law.

3.9 Third-Party Links and Services

LaiPower may include links or functions for third-party websites, payment gateways, maps, e-wallets, social media, merchant pages, or services. These are operated independently and may be subject to their own terms.

3.10 User Representations and Warranties

Users represent that they are at least 18 years old or have proper consent, can understand these Terms, will comply with law, will not misuse services, and provide accurate information.

3.11 Force Majeure

LaiPower is not responsible for delay, interruption, failure, or loss caused by events outside its reasonable control, including natural disasters, war, government action, network or power failure, supply issues, epidemics, or venue restrictions.

3.12 Wireless Features and Communication Charges

LaiPower services may require mobile networks, SMS, push notifications, email, location services, Bluetooth, camera, or other phone functions. Users are responsible for carrier charges and device permission settings.

Users may stop using LaiPower services at any time. After termination, the user's right to use the services ends, but the user must still pay outstanding fees and return any unreturned devices.

LaiPower may suspend, restrict, or terminate an account or service access if the user fails to pay, does not return a device, damages or loses a device, provides false information, breaches these Terms, is suspected of fraud or illegal activity, or if LaiPower is required to act by law or a third-party service provider.

LaiPower will process users' personal data according to its Privacy Policy and applicable Malaysian personal data protection laws.

LaiPower may collect and process names, phone numbers, email addresses, account information, payment and transaction information, rental and return records, device, station, and order records, customer support records, App and website usage records, and other information permitted by law.

LaiPower may use this data to manage accounts, provide rental services, process payments and refunds, provide support, prevent fraud and device loss, maintain security, send service notifications, improve services, and comply with legal requirements.

6.1 Contact Information

Users confirm that contact details provided to LaiPower are true, accurate, valid, and belong to the user or are legally authorized for use. Users should update contact details promptly if they change.

6.2 Service Notifications

Users agree that LaiPower may send service-related notifications by SMS, phone call, email, App push notification, WhatsApp, or other reasonable methods.

6.3 Marketing Communications

Users may choose to receive LaiPower marketing, promotions, campaigns, offers, or partner merchant information. Users may unsubscribe through LaiPower methods, App settings, or by emailing laipowersdnbhd@gmail.com.

LaiPower may send notices through In-App notifications, push notifications, SMS, WhatsApp, email, website announcements, or other contact methods provided by users.

These Terms are governed by and interpreted according to the laws of Malaysia.

Any dispute arising out of or relating to these Terms, LaiPower services, device rental, payment, refund, account, or any related matter should first be attempted to be resolved through friendly negotiation.

If the dispute cannot be resolved through negotiation, both parties agree to submit the dispute to the courts of competent jurisdiction in Malaysia.

If a user has any dispute regarding orders, payments, refunds, device returns, accounts, or other service matters, the user should contact LaiPower as soon as possible and provide relevant information for review.

LaiPower will handle the matter based on system records, order records, payment records, device records, station records, and information submitted by the user.

If LaiPower does not immediately enforce any right under these Terms, it does not mean LaiPower has waived that right.

If any part of these Terms is found to be invalid, illegal, or unenforceable, that part will be modified or removed to the necessary extent without affecting the validity and enforceability of the remaining provisions.

All rights and remedies granted to LaiPower under these Terms are cumulative and do not exclude any other rights or remedies LaiPower may have under law or other agreements.

LaiPower's choice to exercise one right does not affect its ability to exercise other rights later.

LaiPower may modify, update, or supplement these Terms from time to time according to business, legal, technical, payment, service, or operational needs.

If material changes are made, LaiPower will notify users through the website, App, email, notifications, or other reasonable means.

Updated Terms take effect from the date published or stated in the notice. Continued use of LaiPower services after updates means the user accepts the updated Terms.

Users confirm that they have read these Terms, understand their content and legal consequences, agree voluntarily, understand that shared power bank services involve certain risks, and agree to use LaiPower services and devices in accordance with these Terms.

To the maximum extent permitted by law, LaiPower provides services, devices, the App, website, and related information on an "as is" and "as available" basis.

LaiPower does not guarantee uninterrupted or error-free services, device availability at all times, full battery status, suitability for every user need, or uninterrupted third-party payment, network, map, SMS, carrier, or external services.

Users should use devices normally, safely, and lawfully. Users are responsible for losses, fees, damage, claims, or injuries caused by improper use, unauthorized modification, abnormal operation, late return, loss, theft, intentional damage, breach of law, providing devices to others, or continuing use after noticing abnormality.

Nothing in these Terms excludes or limits LaiPower's liability for gross negligence, intentional misconduct, fraud, or liability that cannot be excluded by law.

Users agree to indemnify LaiPower, its directors, employees, agents, partners, service providers, and related parties, to the extent permitted by law, against any claims, losses, liabilities, fees, penalties, expenses, or legal costs arising from the user's breach of these Terms, breach of law, improper device use, device damage or loss, infringement of third-party rights, false information, or misuse of LaiPower services.

By registering, logging in, scanning to rent, paying, using, returning devices, or continuing to use LaiPower services, users confirm that they have read, understood, and agreed to these Terms, agree to follow LaiPower service rules, payment rules, and Privacy Policy, understand the responsibilities involved, and confirm that their information is true, accurate, and valid.

These Terms, the LaiPower Privacy Policy, payment rules, refund rules, prices shown in the App or website, usage instructions, and other rules published by LaiPower and applicable to the services constitute the entire agreement between the user and LaiPower regarding use of the services.

If any part of these Terms is inconsistent with the real-time rental price, deposit, fees, refund, or usage rules displayed in the App, web application, or payment page, the specific rules displayed in the App, web application, or payment page at the time of rental shall prevail, unless applicable law provides otherwise.

By continuing to access, register, log in, scan to rent, pay, use, or return LaiPower devices, the user confirms that they have read, understood, and agreed to be bound by these Terms.
